The conditions below constitute the agreement between
The Shanti Space and retreat participants.

1. Reservation
To reserve your place on one our retreats please contact info@theshantispace.com and submit it together with the deposit specific to your retreat. 

2. Price
All prices are quoted in Euros / UK Sterling. While The Shanti Space does everything possible to maintain our listed prices, if it is necessary to levy a surcharge or adjust the price due to currency fluctuations, The Shanti Space reserves the right to do so, and notification will be giving before the commencement of the retreat.

3. Payment
Payments must be made by PayPal or Bank Transfer. Final balances are due at least 90 days before the beginning date of the retreat. For reservations made within 90 days of the departure date, full payment is required when the reservation is accepted. If payment of the balance of the retreat price is not received by The Shanti Space by the required time we will assume that you will not be participating on the retreat and cancellation charges in accordance with condition four will apply.

4. Cancellations
If you wish to cancel all or part of your booking once a confirmation invoice has been issued, we must be notified in writing. We will acknowledge your cancellation within 2 days of receipt. Please contact us immediately if you have not received our acknowledgement within this time.

Cancellation charges will be applied at the date we receive the written notification of cancellation. Deposits are not refundable. We strongly recommend that you take out full travel insurance, which includes cancellation cover.

As we incur costs from the time you make your booking, you agree that if you cancel your booking or any element(s) of it, you will compensate us for our expenses and losses up to the maximum charges shown below. Our cancellation charges increase the closer to your confirmed departure date that your written cancellation is received at our offices. This is because we may have to pre-pay our suppliers and there is also a reduced opportunity for us to re-sell your booked arrangements as we near the departure date.

Cancellation charge as a % of total price of the element(s) of the booking cancelled:

More than 8 weeks before departure: Loss of deposit

6-8 weeks of departure date: 50%

Less than 6 weeks of departure date: 100%

Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your insurance policy. Claims must be made directly to the insurance company concerned. 

All refunds are subject to the return of all unused documents. Any amendment charges are non-refundable. It is not possible to make refunds after departure for any services not used.

If any member of your party is prevented from travelling, that person(s) may transfer their place to someone else (introduced by you and satisfying all the conditions applicable to the arrangement(s)) providing we are notified not less than 28 days before departure, meet all costs and charges incurred by us and/or incurred or imposed by any of our suppliers and the transferee agrees to these booking conditions and all other terms of the contract between us. If you are unable to find a replacement, cancellation charges as set out will apply in order to cover our estimated costs.

5. Health and Fitness Requirements
You must be in good physical and mental health to participate on the retreats. You are advised to consult with a physician to ensure that you are in adequate health to safely participate in your retreat. Yoga retreats often take place in remote areas where there is little or no access to normal medical services or hospital facilities for serious problems. Medical and evacuation expenses will be your responsibility, so The Shanti Space strongly encourages you to purchase travel insurance. Additionally, The Shanti Space and the retreat leader reserve the right in their absolute discretion to refuse a participant the right to participate in a retreat on medical or fitness grounds.

6. Cancellation due to Retreat Booking Numbers
The Shanti Space reserves the right to cancel any retreat prior to departure in the event that there are too few people booked in which case you will be given a full refund of any and all payments made to The Shanti Space. You will not be entitled to claim any additional amounts or seek any compensation for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to visa, passport, flight, and vaccination costs.) Therefore, The Shanti Space recommends you have travel insurance. 

7. Changes, Postponement, Cancellation or Delay
The Shanti Space reserves the right to make changes to any aspect of the retreat if, in the absolute discretion of The Shanti Space, it is necessary to do so due to conditions that are likely to be hazardous or dangerous or due to any other adverse or threatening conditions whether political or military or terrorist or otherwise or if an act of omission of a third party prevents the retreat or the aspect of the retreat being undertaken in accordance with your booking or for any other reason considered necessary by The Shanti Space. If the designated trip leader is unable to lead the trip for any reason, The Shanti Space, in its discretion will enlist another teacher to lead the retreat. 

In the event of any change, modification, cancellation, postponement or delay under this condition, you acknowledge that you will have no right of refund of the retreat price in whole or in part and no right to claim compensation for any injury, loss or damage or other additional expenses incurred by virtue of the change, modification, cancellation, postponement or delay. The Shanti Space also reserves, in its absolute discretion, the right to cancel any retreat due to any government travel warning or advice, or any change in such warning or advice. In this event, we will do all we can to refund any payments made or transfer to a future retreat with The Shanti Space. If this is not possible, travel insurance may compensate you depending on the circumstances.

8. Insurance

You must be adequately insured to cover your booked arrangements, extreme sports, your particular needs and which provides cover, as a minimum, for the cost of cancellation by you, a 24-hr emergency and repatriation service in the event of accident or illness, loss of luggage, delay and curtailment cover plus loss of personal items and cash. The Shanti Space accepts no liability for any clients travelling without adequate travel insurance. Please note that insurance must be valid / effective from the date of booking, to cover you in the event of unavoidable cancellation due to illness etc. We may ask for evidence of cover. Any other excursions or hazardous activity in which you partake locally, such as trekking, tobogganing, paragliding, inner-tubing or snow-mobiling etc, are at your own risk and liability and may not be covered under the terms of your holiday insurance. Please check the details of your individual policy before participation.

9. Travel Documents and Vaccinations

It is your responsibility to ensure that you are in possession of all necessary travel and health documents before departure – including ensuring their validity extends beyond the end date of your holiday. All costs incurred in obtaining such documentation must be paid by you. We regret we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry correct documentation. If you or any member of your party is not a British citizen or holds a non EU passport, you must check passport and visa requirements with the Embassy or Consulate of the country(ies) to or through which you are intending to travel. If failure to have any necessary travel or other documents results to fines, surcharges or other financial penalty being imposed on us, you will be responsible for reimbursing us accordingly. The Shanti Space is not responsible for any delays or cancellations due to client’s lack of proper travel documents.

10. Photography
The Shanti Space reserves the right to use photographs or videos from the retreat for promotional purposes. By making a reservation with The Shanti Space, you agree to allow your image to be used in such photography. If you prefer for your image not to be used, please notify The Shanti Space in writing before the retreat commences. 

11. Force Majeure
If The Shanti Space and the trip leader are prevented (directly or indirectly) from performing any of their obligations under this agreement by acts of God, strikes, trade disputes, fire, breakdowns, interruption of transport, government or political action, acts of war or terrorism, acts or omissions of a third party or for any other cause whatsoever outside The Shanti Space and the trip leader's reasonable control, The Shanti Space and the trip leader will be under no liability whatsoever to you and may either cancel the retreat or take any other action as specified in condition twelve.

12. Assumption of Risk
You acknowledge adventure travel is more challenging and demanding with a commensurately higher level of risk compared with conventional vacations, and it involves potential exposure to injury and that in the countries and regions in which adventure travel is undertaken, standards of accommodation, transport, health care, hygiene, safety and service provision generally are often not as high as those standards in your country of residence and may require flexibility and patience on your part. You further acknowledge that operational control of the retreat will be in the hands of a third party and that your right of action in regard to any shortcomings of that third party's performance is against the third party and not against The Shanti Space.

13. Release and Waiver of Liability
In consideration of The Shanti Space accepting your reservation you release, waive, discharge, hold harmless and agree to indemnify The Shanti Space, its officers, its employees, its agents, its licensees, other representatives, and trip leaders from all claims, actions or losses for bodily injury, emotional trauma, property damage, wrongful death, loss of services, loss of profits, as well as consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during your travel in connection with the retreat or any activities conducted in conjunction there within unless caused by the willful negligence or wrongful act of The Shanti Space and its employees. Regardless of the situation or circumstances giving rise to the claim, you waive any claims you have, or may at any time have, against The Shanti Space and its employees, you agree, by accepting the additional inherent dangers and risks associated with the retreat, not to make any claim against or seek any compensation from The Shanti Space and its employees in respect to any personal injury, illness or death suffered by you or damage to or loss of property sustained by you as a result of your participation in the retreat including without limitation, any extracurricular activities you may engage in during the retreat, whether or not sponsored by The Shanti Space.
